Oafare is provided solely to assist travel consumers in gathering travel information, making travel plans, determining the availability of travel-related goods and services, making legitimate reservations or otherwise transacting business with partner travel suppliers, and for no other purposes. By accessing this Website, accessible from https://www.oafare.com, you are agreeing to be bound by these Website Terms and Conditions of Use and agree that you are responsible for the agreement with any applicable local laws. If you disagree with any of these terms, you are prohibited from accessing this site. The materials contained in this Website are protected by copyright and trademark law.

General Information

Oafare is owned and operated by Oafare, Inc. a subsidiary of Tzedakahs Row, Inc. (registration No. 1658681) with offices , and its subsidiaries (hereinafter – “Owner”). Oafare refers to a metasearch booking engine software product or, simply stated, an online service intended for personal, non-commercial purposes.

Important! Oafare is not a service that allows you to purchase flight tickets or other services/products on our website. Any commercial relations with the user regarding a purchased service found on Oafare occurs on the side of Oafare's partners. We do not participate in the purchase process in any way. In case of disputes, you agree to adhere to their resolutions directly and with the parties who entered into such purchasing agreement with you in providing relevant services to their authorized agents including:

  • for the user to search and receive, based on their queries and the functionality of the metasearch booking engine software, information about flight tickets and other travel services offered by, third parties, and affiliates including airlines, OTAs, booking systems, hotels, etc. (metasearch service), which are partners of the Oafare, as well as to facilitate (partially automate) the purchasing (booking) process within the assisted booking interface;

  • to track and provide the user who subscribed to Oafare’ Fly-High program and newsletters with statistical information about the price of flight tickets and other travel products for specified destinations, as well as promotional information about Oafare and third parties through electronic communication channels, including messengers and push notifications;

  • to provide Oafare-authorized affiliate users with the opportunity to personalize the functionality of pages, including remembering data specified by the user and saving the settings for the assisted booking process;

  • to provide the user with information about travel on Oafare blog (for informational purposes only);

  • to provide the user with the opportunity to participate in promotions and contests (marketing online events and special projects), organized by Oafare and/or partners and related domains;

  • to fulfill other legitimate purposes that are implied and can be met by using Oafare's functionality exclusively through the user interface.

Please take note: That posting information and content in any form regarding flight tickets, products, services, and providers of such services on Oafare constitute neither a recommendation, instruction, or a call to purchase such a service nor an assessment or comparison of such services and its partners.

Use License

Permission is granted to temporarily download or copy materials on Oafare for personal, non-commercial transitory viewing only unless given written consent to do so, and under this license you may not:

​

  • modify or copy materials;

  • use any materials for any commercial purpose or public display;

  • attempt to reverse engineer any software contained on Oafare's Website;

  • remove any copyright or other proprietary notations from materials; or

  • transfer materials to another person or "mirror" such on any other server.

This will cause Oafare, Inc. to terminate your use of our website if any violations are committed due to these restrictions. Upon termination, your viewing right will be terminated and you should destroy any downloaded materials in your possession whether it is printed or electronically formatted, and;

  1. By using Oafare and visiting websites or applications of partners and site owners, you confirm that you have reached the required age for use of travel related services and offers provided, have the necessary legal capacity to do so, and have received necessary consents and permissions if you act in the interest of another person, to provide accurate, full, and reliable information when using Oafare and partner sites.

  2. Oafare grants you, free, non-exclusive and non-transferable license to use and access Oafare on a personal device in any country, for the direct functional purpose of travel related planning, research, or booking travel, and exclusively for the legitimate purposes specified in the our terms.

  3. Interaction with Oafare, including the generation of search queries for flight tickets, is carried out exclusively by means of the digital interface provided to users.

  4. When using Aviasales, you agree:

    • not to interfere with Oafare's work in ways that may result in a violation of its performance, including forming requests in ways other than through our user interface;

    • to not use any programs or applications that are not authorized by other owner's when interacting with Oafare;

    • to not modify, improve, translate into other languages, decompile, disassemble, decode, frame, emulate, violate the integrity of, or restore the source code of Oafare or any of its parts;

    • and not use Oafare or content available throughout the website for illegal purposes, or pursue an unfair purpose, for example, go to partner sites and make fraudulent bookings.

  5. Websites owners has the right, at any time, at their sole discretion, to terminate maintenance, change the functionality, as well as prohibit a specific user, when that user has been requested to stop using Oafare.

  6. By means of Oafare, users are also given the opportunity to personalize the functionality of their accounts and profiles to suit their needs. You agree that giving authorizing on our website/app, to use the account assigned to you on Oafare and thus provide access to certain features, promotions or search history, is also regulated in the same way as unauthorized access.

  7. Oafare has the right, at any time, to remove any content and/or restrict the access of other users to said content, if such content actions may potentially, in any way, violate these Terms, Privacy Policy, applicable legislation, or generally accepted behavioral norms on the internet, or threaten the security of our service or the service of partners or third parties as well as their psychological state.

Disclaimer

All the materials on Oafare.com is provided "as is". Oafare makes no warranties whether expressed or implied, and therefore negates all other warranties. Furthermore, Oafare does not make any representations concerning the accuracy or reliability of the use of the materials on third-party or partner websites otherwise relating to such materials or any sites linked to this Oafare.com.

  1. The Oafare travel services functionality is provided "as is." We do not provide any warranties regarding error-free and uninterrupted operation, its parts, components, functions, or compliance of functionalities to specific expectations of users. Additionally, Oafare does not guarantee the veracity, accuracy, completeness, and timeliness of data provided by third-parties or our partners, nor provide warranties, which are not expressly stated in these terms, including when providing support services and use of its metasearch service or other available functions.

  2. Oafare will not be held liable for any direct or indirect consequences from the use or inability to use the website (including data) and/or damage caused to you and/or third parties/partners as a result of such use, non-use or inability to use separate components or functions, including due to possible errors or failures in operation.

  3. You agree to use Oafare in accordance with the laws of your Country, State, City, or borough, and bear liability for violating any restrictions set and mentioned herein, or its different functions according to respective legislation within your region(s).

  4. You are solely responsible for violating any restrictions or laws when using third party and partner websites, including actions resulting in the violation of those rights and legitimate interests of third parties/partners, as well as for compliance with applicable legislation when using Oafare.

 Intellectual Property

  1. Intellectual property rights on intellectual property objects and constituents Oafare and/or used by it (software and hardware product, interface, algorithms, design, mechanics of interactions, texts, images, databases, knowledge, trademarks, trade names, other means of identification, etc.), as well as domain names, are vested in the respective owners or third parties, which are the rights of those holders and who hold licenses, or are distributed by the owners on behalf of the rights holder.

  2. Intellectual property objects and other third-party, partner content, exclusive rights to which are not licensed or not vested in the owner, are displayed solely to inform users about a particular airline, OTA, booking system, etc. which are available, for example, a search results page on Oafare. Nothing should be construed as our pretension to such third-party, partner content or as granting, any license(s) or right to use displayed content on Oafare without the expressed written consent of its respective owner.

  3. The use of the intellectual property objects specified in section 1. is only possible within the framework of the functionality offered by Oafare. You agree that the use of Oafare does not grant you the user any rights for the specified intellectual property objects, except for rights explicitly specified in the these terms.

  4. Any content that Oafare receives from you, upon authorization or through any other use of our platform, must be rightfully accessible to you and must not violate the rights and legitimate interests of third parties, and partners, or applicable laws. When you provide Oafare with free of charge, perpetual, transferable, revocable, sub-licensable license to use, modify, reproduce, distribute, and prepare derivative works of, publicly perform, and publicly display (in any form and on all mediums now known or hereafter devised) all content provided; Oafare can use such content in any format, channel, platform, or territory, country, city, or state with the right to localize it into other languages if uploaded or submitted to us. You further give permission and the right to use your name, image, or other personal attributes in connection with such content.

Limitations, Supplier Rules and Restrictions

Oafare or its suppliers will not be held accountable for any damages that arises with the use or inability to use the materials on its Website, even if an authorized representative has been notified, orally or written, of the possibility of such damage. Some jurisdiction does not allow limitations on implied warranties or limitations of liability for incidental damages, these limitations shall not apply to you.

Additional terms of use will apply to your purchase of travel-related goods and services. Please read these additional terms of use carefully.  In particular, if you purchased airfare, ensure you read the full terms and conditions of carriage issued by the Supplier. You agree to abide by the terms of use of purchase imposed by any third-party and partner, supplier with whom you purchase travel related products or services with, including, but not limited to, payment of amounts due and compliance with their rules and restrictions on use of fares, availability, products, or services.

 

Airfares are only guaranteed once the purchase is completed and your ticket(s) have been issued. Travel suppliers and airlines may change their pricing without notice.

 

Federal law prohibits the carriage of hazardous materials aboard an aircraft, in your luggage, or on your person. A violation can result in up to five years' imprisonment including penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, solids, flammable liquids, oxidizers, poisons, corrosives and radioactive materials. Examples include: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals.   There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials on your person.

 

You acknowledge that some partner travel providers offering certain services may require you to sign their liability waiver prior to buying their service or participate in an activity they may offer. You understand that any violation of that supplier's rules and restrictions may result in the cancellation of your reservation(s), and being denied access to the applicable travel product or services. As such, in your forfeiting those rules and/or restrictions, any monies paid for such reservation(s), debiting your account for any costs incurred may result due to such violation. In addition, Oafare will not be held liable for any costs incurred due to relocation.

LOW PRICE GUARANTEE

With Oafare, your confidence booking with us and finding lower fares means everything. That is why, if you find a lower price with the same flight itinerary, and "available for booking", on a Major (OTA) Online Travel Agency' competitor’s site, we will match that price by refunding the difference on that lower priced itinerary (providing its within 24-hours of booking), or you can cancel your booking where your ticket was purchased, and we'll offer a refund on the difference. That’s our Low-Price Guarantee (“LPG”).

What is an "itinerary”?

"Itinerary means every element of a flight travel offer matches; from the flight number(s), airline(s), itinerary, date(s), number of travelers etc. and seat type.

What does “available for booking” mean?

Available for booking means the fare and itinerary you found is live on the (OTA) Online Travel Agency competitor’s site you made the booking with, and available to other customers. Important, said itinerary must be available at the time of your contact with us, and determined by Oafare's customer service specialists.

​

What do you mean by “Major OTA Competitor”?

For purposes related to our guarantee (LPG), OTA competitor means websites such as Travelocity, Cheapoair, Cheaptickets, Expedia.com, Orbitz.com, cheapflights.com.

​

How does someone notify you to invoke the LPG?

To invoke this (Low Price Guarantee), simply contact us at support@oafare.com with the booking number from anyone of our partners you booked your trip with and other key details such as (airline(s), flight(s), itinerary, date(s), seat type) etc. along with the exact URL or screen shot(s) that will help our customer service specialist(s) verify your invoked claim in order to honor the terms of use of our LPG. We must be able to locate the lower fare based on the information you provide. Note: Oafare reserves the right to deny claims that cannot be verified, or where incomplete information was provided to us. Upon verification the LPG is valid, you will be given a choice to either keep your booking with a refund for the difference in price or cancel the itinerary made on the partner site you made that booking with for a full refund.

Are there any exceptions to the LPG?

Our (LPG) does not apply to discounts and lower fares offered through member programs on competitor's websites including group rates; charters, rewards program, incentives, consolidator fares; or those available by using coupons and other promotional offers. Exclusions apply to Military, students, tour operator, vacation packages, government, bulks or "Web Only" fares. Where airline booking details are unknown until after a purchase or issued under “auction” "name your price" model does not apply to (LPG). Errors on fares also does not apply.

International Users

Oafare's collection of low flight and hotel rates through multiple online channels, search and query, is controlled, operated and administered by Oafare from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all international laws in your country of origin. You agree that you will not use Oafare's content accessed through https://www.oafare.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless Oafare, its officers, directors, employees, agents, third parties and partners for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this agreement or your violation of any rights of a third party/partner, or your violation of any applicable laws, rules or regulations. Oafare reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Oafare in asserting any available defenses.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these terms of use, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these terms of use will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Oafare agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THIS SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. OAFARE AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME. In the event of a dispute, you agree to electronically,  or send your complaint to Oafare's legal physical address. The response period is 30 days from the date Oafare receives the electronic version. If you do not consider your complaint resolved within the time limit set for response, you have the right to appeal to the court in accordance with U.S. statutes.

  6. If you wish to leave any feedback regarding the use of Oafare, the text of the present terms, or to clarify questions you may have regarding said use, you can contact our support team. If you are a right/copyright holder and believe any content on Oafare violates your that right, please write to our legal team.
